Competition Law


Every large Kenyan and cross-border commercial transaction, merger or acquisition transaction requires a firm to consider the implications and applicability of competition and anti-trust regulations. There being a number of regional intergovernmental regulations for example, the Competition Act of Kenya & the Common Market for Eastern and Southern Africa (COMESA), we have in major transactions where regulations are applicable, guided clients in making applications and advised on regulatory compliance.


Notable Transactions


  • Advising Kenya Ports Authority, on a joint venture agreement relating to operations within the port of Mombasa. The transaction value in excess of US$650million, which required COMESA (Common Market for Eastern and Southern Africa) approval and Kenyan Competition Authority approval.
  • Advising Vipingo Ridge Limited on an investment in the company for an excess of US$6million. The investment required Kenyan approvals.
  • Advising Sunsail Trading Company Limited on an investment in the company for an excess of US$6million.
  • Advised M-Oriental Bank on regulatory and statutory compliance on an investment into the bank by a foreign entity.
